What Is a DOT Consortium and Do I Need One?

A DOT Consortium, also called a C/TPA (Consortium/Third Party Administrator), manages random drug and alcohol testing pools on behalf of employers. If you are a small employer — particularly owner-operators and small trucking companies — you are generally required to participate in a random testing consortium.

Random Testing Rates (Current Federal Minimums)

  • FMCSA (trucking): 50% of drivers for drug testing, 10% for alcohol testing annually

Post-Accident Testing: When Is It Required?

Post-accident testing under FMCSA must be conducted as soon as practicable after a qualifying accident involving a commercial motor vehicle. A qualifying accident includes any accident that results in a fatality, any accident in which a driver receives a citation AND there is an injury requiring medical treatment away from the scene, or any accident in which a driver receives a citation AND a vehicle requires towing.

Time is critical for post-accident testing. Alcohol testing must be completed within 8 hours of the accident. Drug testing must be completed within 32 hours. What Happens After a Positive DOT Drug Test?

When an employee tests positive on a DOT drug test, the results are reviewed by a Medical Review Officer (MRO) before being reported to the employer. The employee must be immediately removed from safety-sensitive duty. They cannot return until they have completed a Substance Abuse Professional (SAP) evaluation, followed any treatment recommendations, and passed a return-to-duty test.
